General Terms and Conditions (GTC)

For distance and electronic commerce via our website theperfumecollective.com or by telephone for the purchases of private customers

1. when do our GTC apply

These general terms and conditions apply to all orders of goods from us, the purchase of our voucher cards and telephone orders under the telephone number +49 (0)30 8973 2569.

2. how and when the contract is concluded

Our information on goods and prices within each order process are subject to change and non-binding. You first make a binding offer to purchase by placing your order via the “Buy now” button, which only then requires our acceptance. Only with this acceptance a binding purchase contract for the ordered goods is effectively concluded. There is no obligation on our part to accept their offer.

Your order is accepted by us to the extent and by confirming the shipment of the goods or vouchers electronically, i.e. by e-mail.

3. our cancellation policy, your right of cancellation

You have the right to cancel this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the supplier, has taken possession of the goods or the goods. This also applies if you have ordered different goods but they are delivered separately. It always depends on the receipt of the goods/goods by you.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

The consequences of the revocation are as follows:

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the deadline of fourteen days. You only have to pay for any loss of value of the goods if this loss of value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.

4. delivery

Standard deliveries within Germany and Austria are free of shipping costs from an order total of 50.00 euros. Order total means the subtotal for all products in an order less any discounts granted. If the order total of an order is below this amount, we charge a flat rate of € 3.99 for delivery within Germany. Standard deliveries are made in Germany to the delivery address specified in the order. Depending on the shipping method, delivery can also be made to a packing station. With a standard delivery via DHL within Germany, your order will be delivered within 2-3 business days. Public holidays and public holidays, within Germany vary and could affect the delivery time of your order. This may result in postponement of delivery by up to two working days following the holiday. We are entitled to make partial deliveries insofar as this is reasonable for you after weighing your and our interests. In the case of partial deliveries, we shall bear the additional shipping costs incurred as a result. The dispatch of partial deliveries shall be at our risk. With the receipt of each partial delivery, the risk for the delivered items passes to you.

5. payment options

Payment is made via PayPal and bank transfer to our account (each in advance).

6. redeeming vouchers

If you have received a voucher with your order (see order documents), you can redeem it when purchasing an original perfume (value of goods min. 80,- €) via our online store www.theperfumecollective.com. When your selected product is in the shopping cart, enter the coupon code in the provided line to secure your discount. Only one voucher is valid per purchase and no other offers or quantity discounts can be used. The voucher is valid for up to three years after purchase. Partial redemption is not possible. 7. warranty for defects

The product images do not always have to match the appearance of the delivered products. In particular, changes in the appearance and features of the products may occur after manufacturers renew their product ranges. Claims for defects do not exist insofar as the changes are reasonable for the customer. If the goods are defective, we shall provide subsequent performance within a reasonable period of time, i.e. either replacement delivery or elimination of the defects. If the supplementary performance chosen by you is only possible at disproportionate expense, we shall be entitled to provide supplementary performance in the other form. The expenses required for subsequent performance shall be borne by us. If we do not succeed in subsequent performance, you shall have the right to either rescind the purchase or reduce the purchase price. Defective goods must be returned to us unless you have decided to reduce the purchase price. Claims for defects shall become time-barred within 2 years from the date of delivery of the goods. The costs for the return shipment in case of a defect are to be borne by us.

8. compensation

Compensation for damages due to breach of an obligation arising from the contractual relationship shall be paid under the statutory conditions. The same shall apply to claims for damages based on the Product Liability Act. All instructions on the packaging and inserts must be observed. No liability is assumed for any application and/or handling deviating from this.

9. alternative dispute resolution

The EU Commission has provided a platform for out-of-court dispute resolution. This gives consumers the opportunity to initially resolve disputes related to your online order without going to court. The dispute resolution platform is accessible under the external link http://ec.europa.eu/consumers/odr/ (this must be designed as an active link!). We will always try to settle any disagreements arising from the contract with you amicably. Furthermore, we are not obligated to participate in any arbitration proceedings.

10. miscellaneous

We reserve the right to change the general terms and conditions at any time. These can be found in their respective current version on our website at any time.

German law applies to our customers in Germany. For customers residing abroad, the purchase law of the country in which the customer usually resides shall apply.
